Actually, the DMCA law doesn't even allow you to make a backup copy of the game onto your computer, it has to be backed up to the same media that it was retrieved from. Which means if you want to backup your NES ROM then you'll have to find old blank NES cartridges somewhere. However, you can plug the NES cart into your computer and play the game directly.
It is illegal to download ROMs. If ROMS are not illegal then why are ROM sites shut down daily? If not then why wouldn't everyone just go around downloading the ROM to the latest XBox game? I'm pretty sure "ROM" doesn't show up in any article that has passed through congress because that's not what they are, that's just your l33t name for them. ROMs are intellectual property which are copyrighted.
