Pocket Matrix most certainly has on average the youngest group of members of any of the online Pocket PC communities. The under-18 group is one of the biggest supporters of warez for several reasons (they tend to have less money, less maturity, do not feel completely responsible for their actions, and seem to always have something to prove so they can make their mark). Of course it is natural for a portion of Pocket Matrix members to be active in the warez scene one way or another, if only because of their age.
Pocket Matrix's stance regarding warez has always been clear; it will not be used as a mechanism for any warez related activities, including directing people to where warez can be obtained. To that end, posts are edited or deleted, and users possibly banned.
However, that is a far cry from banning anyone suspected of warez activity outside of Pocket Matrix. Pocket Matrix cannot hold a "trial", accepting outside "evidence" from the accusers claiming that so-and-so did this-and-that, and thus they should be banned from Pocket Matrix because they are a bad person, or because their moral integrity doesn't meet some predefined standard. Again, if it didn't happen at Pocket Matrix, then Pocket Matrix is not bound to hand down a verdict and perform a disciplinary action of some kind.
Now, for my personal opinions regarding this whole matter of Moose. These are in the context of banning Moose from Pocket Matrix, or attempting to prosecute him and have him thrown in jail.
Assuming the beta had an NDA (which I doubt, because I remember Carpe scoffing at the need for NDAs in the past), then whomever violated the NDA would be the must culpable.
It appears that the beta was already available for download via irc, possible directly from the beta tester. The fact that a 3rd or 4th copy was put online would not make it any more readily available or easier to download. In other words, it would not be possible to quantify how much, if any, additional "damage" resulted from Moose's action.
Moose was a DEXplor beta tester from day one. To my knowledge DEXplor betas have never been leaked.
I think Moose made a bad decision in an attempt to make a statement or take a stance about the whole Ag delay issue. I don't think he was trying to make a profit off of the beta, and I don't think he had ulterior motives such as hurting Ag because he was involved in some way with a competitor. I think he hurt his credibility, and made a stupid decision. That's something he will have to live with.
