I totally and completely understand the stance that Ionside Interactive has taken. This type of situation is not uncommon in the software industry.

But I don't agree with it.

Here are some things to think about:
-------------------------

A) Ionside created the underlying engine. The Ag name and its associated files (graphics, audio names, etc.) are also wholly owned by Ionside interactive. Nobody can touch that. Even Carpe can't take Ag outside the company.

B) A Mod comprised of entirely new files (a total conversion) is wholly owned by the associated creators, as long as the material is original and their own. In other words, a person cannot create a Star Wars mod and claim it as "theirs". Under this circumstance, Ionside had nothing to do with the creation of the Mod, and therefore should not recieve any monies. HOWEVER... The Mod is completely dependent on the engine... keep reading.

-------------------------

A) Once Ionside Launches Ag, immediate sales will be huge. Sales will soon dwindle, but there will be periodic spikes in sales. These spikes will occur at key moments in the PocketPC timeline. Sales of AG will increase during the holiday season- in concert with sales of NEW PocketPCs. Also, enhancement patches will cause spikes in sales. The longer the Ag recieves attention, the longer life it will recieve.

B) The release of Mods are the surest way to ensure Ag will recieve an extended lifespan. With the launch of every Major Mod, Ionside will see another spike in sales. Sure, there will be many lame attempts at mods- but I fully expect at least TWO mods that will blow everyone away. At least one of those mods will be created by Ionside.

-------------------------

A) Ionside has so much invested in Ag, that they are taking measures to prevent parasites from making any money off their product. That is understandable and justified.

B) I do not recall paying Adobe or Idruna for any graphics that I created using their tools. I am able to sell the imagery at a hefty price. I admit that application software is different than gaming software. But they do have something in common- neither is going to guarantee or induce creativity. How many mods have you seen that were complete crap, even though the underlying engine was the most badass thing you have ever seen?

-------------------------

A) Once Ag is launched, Ionside will have the opportunity to change the industry. Everyone will be watching, especially the heavies like Zio and JimmySoftware. Even industry watchers from PC and Console games will be paying attention.

B) Id Software was scrutinized by the industry- because NOBODY can make money by offering their game as shareware. Um... guess what? Their unconventional ways altered the industry landscape, and they have become one of the most influential companies in the world. Yes, it was risky move. But where would Id Be if they hadn't?

-------------------------

A) While we are on the subject of Id, another breakthrough was the idea of licensing the engine. Id didn't invent licensing, but think of the games that are derived from Id technology.

B) Those games are more than Mods, so they required source code. At this time, I don't think the Pocket Gaming industy has matured enough to command the hundreds of thousands of dollars that the Quake engine, Unreal engine and LithTech engines get per license. Of course, I can easily see a company buying out Ionside, once it has a bit more intellectual property under its belt. Once that happens, none of you will be able to develop a Mod and sell it for a game YOU created.

-------------------------

Once again, I respect the stance that Ionside has taken. I stand by the decisions you have made, and will follow the outlined "legal stuff" without argument.

However, I am also in "business" and will not be doing any free mods. If that means I will not be working with the Ag engine, then so be it. I am sure you understand.

Sorry this post is so long, and WAY out of line. But I just had to say something.
